Terms and Conditions

These terms govern the use of the Brain platform, its digital humans, integrations and associated services. By creating an account you accept the terms described below.

1. Acceptance of terms

By accessing or using Brain ("the Service"), operated by Brain AIX ("we", "the Company"), you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of these Terms, you must not use the Service.

We reserve the right to modify these Terms at any time. Changes take effect when published on this page, and the "Last updated" date will be adjusted accordingly. Continued use of the Service after a change constitutes your acceptance of the new Terms.

2. Accounts and eligibility

To use Brain you must create an account with truthful and complete information. You are responsible for keeping your credentials confidential and for all activity that occurs under your account.

  • You must be at least 18 years old, or the legal age of majority in your jurisdiction.
  • You may not share your account with third parties without the Company's express authorization.
  • We reserve the right to suspend accounts showing fraudulent or abusive activity.

3. Digital humans and automations

Brain lets you create "digital humans" — configurable AI assistants — and workflows that act on your behalf through connected tools (MCP, HTTP APIs and other integrations). You acknowledge that:

  1. Delegated autonomy — You are responsible for the actions your digital humans perform within the scope of permissions you configure.
  2. Third-party tools — By connecting external services, you also accept those providers' terms. Brain is not responsible for their availability or behavior.
  3. Usage limits — We may apply rate or volume limits to workflow executions to protect the stability of the Service.
Responsibility for automated actions. Any action executed by a workflow or digital human connected to tools with access to sensitive data or transactions is considered performed under your direct authorization.

4. Plans, payments and billing

Brain offers free and paid plans. Prices are shown on the Pricing page and may change with at least 30 days' notice for active subscriptions.

5. Content and intellectual property

You retain ownership of the data, prompts and content you upload to Brain. You grant us a limited license to process that content solely to operate the Service.

Brain's software, brand, designs and documentation are the property of the Company and are protected by intellectual property laws. You may not copy, modify or distribute these elements without written authorization.

6. Acceptable use

You may not use Brain to:

  • Engage in illegal or fraudulent activities, or infringe third-party rights.
  • Generate or distribute harmful, misleading or identity-impersonating content.
  • Attempt to access other users' systems, accounts or data without authorization.
  • Deliberately overload the Service's infrastructure.

7. Termination

We may suspend or cancel your access to the Service if you breach these Terms. You may cancel your account at any time from your profile settings. After cancellation, your data is deleted in accordance with our Privacy Policy.

8. Warranties and limitation of liability

The Service is provided "as is", without warranties of any kind. To the maximum extent permitted by law, Brain AIX will not be liable for indirect, incidental or consequential damages arising from use of the Service.

9. Governing law

These Terms are governed by the laws applicable in Brain AIX's jurisdiction of registration, without giving effect to its conflict-of-law provisions. Any dispute will be resolved before the competent courts of that jurisdiction.
