1. Introduction and acceptance
Welcome to Brain AIX ("the Platform"), accessible at https://brainaix.online. By accessing and using our services and artificial-intelligence-based technologies, the user agrees to be bound by these Terms and Conditions. If you do not agree with these terms, please do not use the Platform.
2. Description of the service
Brain AIX acts exclusively as a technology provider. The Platform provides various tools related to artificial intelligence technologies, which may include voice cloning, AI-generated content, adult conversations, creation of digital characters, and the implementation of automations and virtual agents.
3. Age requirements
Brain AIX is not intended for minors. Use of the Platform is intended exclusively for people over 18 years of age, or for users with parental authorization and supervision where applicable law permits.
4. Registration and account security
Users can access the Platform via email and password, or through Sign in with Google. The user is responsible for maintaining the confidentiality of their account and for any activity carried out from it.
5. Payments and billing
Payments for the Platform's services are processed by external providers, including Stripe (subject to future changes). Brain AIX does not directly store complete credit card or banking information. Financial information is handled by the respective payment processors in accordance with their own policies and security standards.
6. Acceptable use and restrictions
The user is solely responsible for how they use the Platform's tools and declares that they have the necessary authorizations to do so where applicable.
Brain AIX does not endorse and strictly prohibits the use of the Platform for:
- Illegal activities.
- Child exploitation or the creation/distribution of illegal extreme content.
- Committing fraud or causing harm to third parties.
- Activities that endanger the integrity or safety of individuals.
If Brain AIX receives valid requests related to usage violations, improper content, or unauthorized use of voices, it may restrict, suspend, or remove such content or account without prior notice.
7. Intellectual property and user content
User rights: The user retains the rights to the content they upload or generate within the Platform (chats, images, documents, audio, etc.), provided they hold the corresponding legal permissions.
User warranty: By using Brain AIX, the user declares and warrants that they have the necessary rights, authorizations, or permissions over any content, image, voice, audio, or material they use on the Platform.
License of use: The user grants Brain AIX a broad, limited, and operational license to use, process, store, reproduce, and transform such content exclusively for purposes related to the operation, improvement, and functioning of the Platform.
Brain AIX ownership: The technologies, digital humans, internal systems, and models developed by Brain AIX remain the exclusive property of Brain AIX.
8. Public and shared content
Some Brain AIX features may allow the user to share public profiles, share content via links, or publish characters or generated content. The user accepts that any content shared through these public modes may be visible to other users or third parties.
9. Third-party dependencies
Brain AIX uses tools, APIs, and infrastructure from third-party providers (such as OpenAI, Gemini, Deepgram, Stripe, Alibaba Cloud) to operate and optimize its services. The operation of the Platform is subject to the availability of those services.
10. Privacy and personal data
The collection, storage, and use of the user's personal information is governed by our Privacy Policy. By using the Platform, the user accepts the international transfer, storage, and processing of their information, including infrastructure and servers that may be located in the United States or other jurisdictions.
11. Limitation of liability
Although Brain AIX implements reasonable security measures, no system is completely secure, and absolute protection against unauthorized access, leaks, attacks, or external failures is not guaranteed.
The user is solely responsible for the content they generate, upload, process, or share through the Platform. Brain AIX will not be liable for:
- The user's misuse of AI tools.
- Unauthorized use of voices, images, or protected content.
- Decisions made based on AI-generated results or content.
- Actions, outages, or failures of third-party providers.
- Any indirect damages or damages arising from use of the service.
12. Changes to the terms
Brain AIX may modify these Terms and Conditions at any time. Continued use of the Platform after such changes are published constitutes full acceptance of the updated version.
13. Governing law and jurisdiction
These Terms and Conditions shall be interpreted in accordance with the laws of the United Arab Emirates. Any dispute arising in connection with the use of the Platform shall be submitted to the competent jurisdiction of Dubai.
